Welcome to Surprise From Me. These Terms & Conditions govern your use of the Surprise From Me service.

1. About the Service

Surprise From Me is a digital platform that allows users to create personalized experiences for another person and share those experiences through a unique, unlisted link.

2. Creating a Surprise

The creator is responsible for the information, photos, messages, and other content they submit when creating a surprise.

The creator is also responsible for selecting the options and information used to create the surprise, including its availability period and, where applicable, its birthday date, time, and recipient time zone.

3. User Content

Users should only upload or submit content that they have the right or permission to use and share.

Users remain responsible for the content they submit to the service.

Use of the service is also subject to our Content Guidelines.

By using the service, you agree not to submit content that violates those guidelines or these Terms.

4. Acceptable Use

Users must not use the service to create or share content that is unlawful, abusive, threatening, sexually explicit, harassing, hateful, misleading, or otherwise prohibited by applicable law or our Content Guidelines.

The Content Guidelines provide additional requirements relating to prohibited content, including inappropriate content involving minors, impersonation, spam, and advertising.

We may take action against content or experiences that violate these Terms or the Content Guidelines.

5. Surprise Links

Surprises are accessed through unique, unlisted links.

The link is not associated with a user account or login. Anyone who obtains the link may be able to open the surprise while it remains available.

The creator is responsible for deciding who receives the link and should avoid sharing it publicly if they want to limit access.

6. Payments

Paid features are offered according to the pricing displayed at the time of purchase.

Surprise From Me currently uses its payment flow in a testing/transition stage and may introduce or change payment-processing providers or methods as the service develops.

Any applicable payment, cancellation, or refund terms are described on the Cancellation & Refunds page.

7. Digital Delivery

Surprise From Me provides digital content and experiences. No physical products are shipped.

After successful payment and successful creation of an experience, the creator receives access to the generated surprise link.

The recipient does not need an account to open a surprise.

8. Expiration

The availability period of a surprise depends on the duration selected for that surprise.

When the availability period ends, the surprise is no longer available to the recipient.

Expiration ends access to the surprise. It does not necessarily mean that the underlying information, photos, or other stored content are immediately deleted.

9. Reporting and Removal

Users can report a surprise using the available reporting mechanism.

When a surprise is reported, the reported experience may be disabled immediately to prevent further recipient access while the report is handled.

We may review reported content and take further action where appropriate.

Submitting a report does not guarantee that content will be permanently removed.

10. Intellectual Property

Surprise From Me's software, design, branding, and original materials are owned by or licensed to Surprise From Me and may not be copied, reproduced, or used without permission except where permitted by law.

Users retain responsibility for the content they submit and must ensure that their submitted content does not infringe the rights of others.

11. Service Availability

Surprise From Me may modify, suspend, restrict, or discontinue parts of the service as necessary, including for maintenance, security, technical issues, or changes to the service.

We do not guarantee that the service will always be available or error-free.

12. Changes to the Service and These Terms

We may update or modify the service and these Terms from time to time.

When changes are made, the updated Terms will be published on this page.
